Terms & Conditions

1) Acceptance of terms

By accessing this website, requesting a quote, uploading files, or purchasing services, you agree to these Terms and to any policies referenced (Privacy Policy, Acceptable Use). If you don’t agree, do not use our services.

2) Services we provide

We offer 3D printing, prototyping, customization of consumer products, and industrial/commercial parts, including finishing and basic assembly. We may use in‑house equipment and/or qualified partners.

3) Quotes, orders & changes

  • Quotes are estimates based on the files and requirements you provide and are valid for 30 days.
  • After you approve a quote and pay (or provide a PO if approved for terms), we schedule production.
  • Any design changes, material swaps, tolerance updates, or finishing changes after approval may require a revised quote and schedule.
  • We may decline an order for technical, legal, or safety reasons.

4) Uploaded designs & your content

  • You retain ownership of your designs. You grant us a limited license to use, copy, modify (e.g., supports/orientation), manufacture, and store your content solely to provide the services.
  • You represent that you have all rights and permissions to manufacture the designs and that fulfilling your order won’t infringe any third‑party rights.
  • Prohibited content: illegal, unsafe, or restricted items (e.g., regulated firearm components, weapons, parts intended for life‑support, aerospace flight‑critical, or other safety‑critical end uses unless we explicitly agree in writing).
  • We do not verify export controls on your behalf. You are responsible for compliance with export, embargo, and sanctions laws.

5) Design for Additive Manufacturing (DFM) & approvals

We may offer DFM recommendations (e.g., fillets, wall thickness, orientation, material). You are responsible for final design decisions. Proceeding with production after receiving our quote/notes constitutes approval of the final material, orientation, finish, and tolerances listed on the order.

6) Tolerances, materials & finishes

Unless otherwise agreed in writing on the order:

  • FDM/FFF: ±0.20 mm or ±0.20% of nominal (whichever is greater), surface finish per process, layer lines visible.
  • Resin (if/when offered): ±0.10 mm typical on small features; material‑dependent.
  • Color & texture: may vary between batches and materials; CF/GF/ESD materials have a matte/filled appearance and are abrasive (may show nozzle artifacts).
  • Heat‑set inserts/assembly: press‑fit results vary with geometry and material; minor sink/marking may occur.

For critical fits, specify key dimensions and provide a drawing. We’ll confirm feasibility or quote additional finishing/machining if needed.

7) Testing, prototypes & end‑use

Unless stated otherwise, our parts are sold as prototypes or non‑safety‑critical end‑use components. You are responsible for testing and validating suitability, strength, and safety in your application (including environmental, chemical, thermal, and load conditions).

8) Reprints, returns & nonconformities

  • If a part fails to meet the agreed material/spec/tolerance on the order, notify us within [7] calendar days of delivery with photos and measurements. We will, at our option, reprint or refund the nonconforming portion.
  • We are not responsible for issues caused by design defects, inadequate testing, misuse, or post‑processing performed by others.
  • Custom parts are not returnable except for defects against agreed specs.

9) Lead times & delivery

Lead times are estimates, not guarantees. We are not liable for delays caused by supplier issues, machine downtime, shipping carriers, or events beyond our control. Title and risk of loss transfer to you when we hand items to the carrier or upon pickup.

10) Pricing, payment & taxes

Prices are in USD unless stated. We may require full or partial prepayment. You’re responsible for applicable taxes, duties, and fees. Late invoices may accrue interest at [1.5% per month] (or the maximum permitted by law).

11) Confidentiality & NDA

We keep your proprietary information confidential and use it only to deliver services. If your organization requires a specific NDA, send it to info@badgeradditiveengineering.com for signature before you upload or order.

12) Marketing photos

We won’t share photos of your parts publicly without your permission. If you grant permission, you authorize us to display images and brief, non‑confidential descriptions of the project.

13) Warranties & disclaimers

Services are provided “as is”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. No oral or written advice creates a warranty.

14) Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of these Services is limited to the amount you paid for the specific order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or product recall.

15) Indemnification

You agree to indemnify and hold us harmless from claims, damages, and costs (including reasonable attorneys’ fees) arising from (a) your designs/content, (b) your misuse of parts, or (c) your violation of these Terms or applicable law.

16) IP complaints (DMCA)

If you believe content we manufactured infringes your IP, send a notice to info@badgeradditiveengineering.com with: your contact info, the work claimed to be infringed, the material at issue, a statement under penalty of perjury, and your signature. We may request proof of ownership and suspend work while we review.

17) Third‑party links & tools

Links to third‑party sites/tools are provided “as is”. We’re not responsible for their content or practices.

18) Suspension & termination

We may suspend or terminate access if we believe you violated these Terms, provided false information, or pose a risk to others or to our operations.

19) Governing law; disputes

These Terms are governed by the laws of Wisconsin, USA (without regard to conflict‑of‑law rules).
The parties submit to the exclusive jurisdiction of the state and federal courts located in Dane, Wisconsin.

20) Force majeure

We’re not liable for delays or failures caused by events beyond our reasonable control (e.g., outages, supply chain disruptions, natural disasters, new regulations).

21) Changes to Terms

We may update these Terms. The updated version becomes effective on posting. Material changes may be notified via email or site notice.
